ONLINE COACHING TERMS - HUMAN 1st PERFORMANCE
Welcome to Human 1st Performance LTD, an online fitness coaching platform founded by David Tilston. By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully, and contact us if you have any questions.
1. Acceptance of Terms
By using our website and services, you confirm that you have read, understood, and agree to these terms and conditions, as well as our privacy policy. If you do not agree with any part of these terms, you must not use our services.
2. Services
Human 1st Performance LTD provides online fitness coaching services including but not limited to personalized workout plans, fitness & health advice. All content and services provided are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.
3. User Responsibilities
You are responsible for ensuring that all information you provide to us is accurate and up-to-date. You agree to follow all exercise plans and information provided to you by Human 1st Performance LTD at your own risk, and consult with a healthcare professional before starting any new fitness program. If you have had ANY medical condition prior to joining or an existing medical condition on joining it is essential that this is disclosed to your coach. You also agree that if any medical condition is experienced during a training progamme, stop and seek the appropriate medical assistance at the earliest opportunity. Your coach should also be informed as soon as possible and a green light must be given by a medical professional prior to resuming training.
4. Online Coaching Payments and Refunds
All payments for services must be made in advance. Refunds are available within 14 days of the initial purchase, provided that you have not yet started the coaching program. If you are on a monthly subscription please inform me (or the original company your contract is with) and a cancellation will be arranged within a 24 hour period and no further payments will be taken.
5. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, and images, is the property of Human 1st Performance LTD and is protected by copyright laws. You may not use, reproduce, or distribute any content without our written permission.
6. Limitation of Liability
Human 1st Performance LTD is not liable for any injuries or health conditions that may occur as a result of following our fitness programs or advice. You agree to release Human 1st Performance LTD, David Tilston, and any associated parties from any and all liability related to injuries or health conditions that may occur.
7. Termination
We reserve the right to terminate your access to our services at any time, without notice, for conduct that we believe violates these terms and conditions or is harmful to other users of our services, us, or third parties, or for any other reason.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom.
9. Changes to Terms and Conditions
We reserve the right to modify these terms and conditions at any time. Your continued use of our services following the posting of changes will mean that you accept and agree to the changes.

EVENT ATTENDANCE & BOOKING TERMS & CONDITIONS - HUMAN 1st EVENTS LTD
1 - All event deposits are non-refundable regardless of circumstances and full fees are non refundable within a 30 day period preceding the start of the event (please see point 3*). If additional transfer or card payment fees are required (2% UK & European and 3.5% International cards) this must be covered by the payee to ensure that the full payment amount is received by the host, after processing fees are subtracted. For example £500 deposit with a 3.5% payment fee means a total amount of £517.50 must be paid to ensure £500 is received.
2 - The full value of the event must be settled as stated by the payment schedule specific to that event. All fees transferred are to hold your space (see point 3*). As stated in point 1, if additional transfer or card payment fees are required (2% UK & European and 3.5% International cards) this must be covered by the payee to ensure that the full payment amount is received by the host, after processing fees are subtracted.. For example a £2500 room fee with a 3.5% payment fee means a total amount of £2587.5 must be paid to ensure £2500 is received.
3 - Refunds will only be issued for an event if your spot can be filled prior to the event occurring, or, if your room can be returned to the hotel / venue prior to the event.
The percentage to be returned is at the hosts discretion based upon individual circumstances. If your spot can be filled you will be refunded 100% of the fee (not including the deposit). However if the spot cannot be filled or the hotel is unable to release (and refund the price of the accommodation) a full charge (of funds submitted) will be retained by the host.
3b - Please note that all refund and payment policies apply regardless of medical reasons (including quarantine), travel disruptions (including cancellation or rescheduling) and event cancellation due to unforeseen circumstances affecting the venue and/or teacher. Because of this it is highly advised that travel insurance is purchased to cover all eventualities as we will be unable to issue a refund.
4 - Incase of government issued guidance that prevents ones attendance (natural disaster, pandemic, health risk, terrorism threat or risk to life) alternative arrangements will be made at the discretion of the host, the event will be re-scheduled and money can be transferred to another event at the same venue within 1 calendar year. Please note that if the value of a different event is higher the total fee will be offset against this value unless stated, if the event is identical, but at a higher fee, your initial payment price will be honoured and you will not be requested to pay the difference.

5 - Various room options are provided on booking with the option to upgrade (if these rooms are available) offered to all. By choosing a standard room you accept that these provide basic amenities for the duration of your stay & upgrades will provide a higher level of service at an additional cost. Rooms are allocated by the hotel based on which room type you have paid for as part of your booking and total booking fees include; administrative fees, exchange rate fees, coaching, accommodation, cleaning and food.

This Privacy Policy sets out our commitment to protecting the privacy of personal information provided to us, or otherwise collected by us, offline or online, including through this website. When we collect, store and use your personal information, we do so in accordance with the rules set down in the General Data Protection Regulation.
